Article 1. Who we are
Presta Support is a trade name of MARK-APP, registered with the Dutch Chamber of Commerce under number 34232861, VAT number NL002076600B51, located at Kennemerlandrecht 35, 1943NN Beverwijk Nederland. Email: info@presta.support. In these terms Presta Support is called "we" and the customer "you".
Article 2. Scope
2.1 These terms apply to all quotes, assignments, orders and support packages of Presta Support.
2.2 We work exclusively for businesses and other professional parties. By giving an assignment or placing an order, you confirm that you act in the course of a profession or business.
2.3 The customer's own terms and conditions do not apply unless we have accepted them in writing.
Article 3. Quotes and assignments
3.1 Before we start an assignment, you receive a diagnosis and a quote with a fixed price. A quote is valid for 30 days unless stated otherwise.
3.2 An assignment is formed as soon as you approve the quote or order and pay for a support package.
3.3 The quote describes what will be done. Work outside it is only carried out after a new quote or your approval.
Article 4. Support packages
4.1 A support package is a prepaid balance of support hours. The number of hours and the validity period are stated with the package.
4.2 We log the time spent per ticket. Your customer account shows how many hours you have left.
4.3 Hours not used within the validity period expire and are not refunded.
Article 5. Performance
5.1 We carry out assignments to the best of our ability and with the care that may be expected of a good service provider. This is an obligation of effort.
5.2 Where possible we test changes on a staging copy first and take a full backup before anything goes live.
5.3 Stated timelines are indications, not strict deadlines, unless agreed otherwise in writing.
Article 6. Your cooperation
6.1 You provide timely and correct information and, after approving the quote, the access we need to your store, hosting or other systems.
6.2 You remain responsible for your store, your hosting and making your own backups.
6.3 You guarantee that you lawfully use the modules, themes and software running in your store. Third-party licences are not included in our price.
Article 7. Prices and payment
7.1 All prices are in euros and exclude VAT unless stated otherwise. For business customers in another EU country with a valid VAT number, VAT may be reverse-charged.
7.2 You pay support packages and online orders in advance through the payment methods on the website: MultiSafepay or PayPal.
7.3 Invoices for other assignments must be paid within 14 days of the invoice date. In case of late payment we may charge the statutory commercial interest and suspend the work.
Article 8. No fix, no fee
If we cannot solve the problem for which we gave a fixed quote, you do not pay for that attempt. This does not apply if the problem cannot be solved because of causes outside our control, such as missing access or information, or changes made by you or third parties during the work.
You pay for a module upgrade in advance. If we cannot get the module working on the PrestaShop version you paid for after all, we refund the full amount.
Article 9. Liability
9.1 Our liability is limited to the invoice amount of the assignment to which the damage relates. For a support package, this is the price of that package.
9.2 We are not liable for indirect damage, such as lost revenue or profit, missed savings, loss of data or damage caused by business interruption.
9.3 We are not liable for damage caused by modules, themes, hosting or other services of third parties.
9.4 The limitations in this article do not apply in case of intent or deliberate recklessness on our part.
9.5 You must report damage to us in writing within 30 days after discovering it.
Article 10. Confidentiality
We treat the data and information we receive from you as confidential. On request we sign a non-disclosure agreement (NDA). How we handle personal data is described in our privacy policy.
Article 11. Intellectual property
After full payment you may use custom work we made for you without limitation for your own store. We may continue to use general knowledge, methods and code not made specifically for you.
Article 12. Termination
12.1 You can cancel an assignment that has not been completed in writing. Work already carried out is paid proportionally.
12.2 We may end an assignment if you do not meet your obligations, after giving you a reasonable period to do so.
Article 13. Applicable law
Dutch law applies to these terms and all assignments. Disputes are submitted to the competent court in the district where we are located.
